Rental Policy/Agreement

  • Equipment not returned on time will accrue a late fee (equivalent to one additional day’s rental charge at full rates plus 5% compounding) for each 24-hour period (or partial 24-hour period) that passes beyond the order’s due date/time until the equipment has been returned or replaced.
  • If a lost/damaged item is part of a larger rental package (thus making the larger package un-rentable), NGP reserves the right to charge a late fee (as stipulated above) for the full package until that item is replaced/repaired.
  • Failure to return rented equipment to NGP (within 72 hours of the due date) may be treated as a total loss, and NGP reserves the right to charge the credit card(s) on file for the full estimated replacement cost of all equipment, plus any applicable late fees. In the event that NGP is not able to secure full payment from the Renter, NGP will file a police report against the Renter. NGP retains the right to reclaim any rented property and seek damages against the Renter.
  • Rental orders that are delivered, picked up, and/or returned outside of NGP’s normal work hours (Monday-Friday, 8am-5pm) may incur an after-hours fee of $30 per hour (or partial hour) per employee per instance.
  • The standard method of acquisition will be for the equipment to be transferred directly from NGP to the Renter (and vice-versa for return). In the event of non-standard acquisition/return (such as shipping, night drop, or third-party pickup/delivery), there may not be a signature on the rental form. The Renter enters into this contractual agreement by virtue of the Renter’s verbal and/or written request for non-standard acquisition/return. The Renter assumes possession of the equipment and all risk and expense for all equipment from the moment the equipment leaves NGP’s possession via the pre-determined method of acquisition until the equipment has been checked back in to NGP.
  • Upon return, the fuel level for each gas-powered item must be equal to (or greater than) the fuel level of said item at check-out. Otherwise, Renter agrees to be charged a refueling fee, equal to the actual cost for NGP to refuel the item plus 10%. All vehicle rentals will be subject to a mileage fee ($0.25/mile), calculated upon return.
  • If a bulb stops working for any reason while in the possession of Renter, Renter must return that bulb to NGP. If the bulb is physically damaged upon return or is not returned to NGP, the bulb will be charged as Loss/Damage. If the bulb is returned to NGP, and there is no sign of physical damage or user error, and it falls within the realm of reason (as determined by NGP) that the bulb has reached its natural life-end, then the Renter will incur no charge for the bulb.
  • In the event that a key is lost while in the possession of the Renter, the Renter agrees to pay for the cost of re-keying/replacing all locks associated with the lost key.
  • Renter assumes responsibility for all damaged and missing equipment (while in possession of the Renter) from any cause whatsoever, including, but not limited to, payment of all loss & damage charges, as determined by NGP, up to the full estimated replacement cost of all equipment, plus any applicable late fees.
  • Renter grants NGP full permission to determine all loss & damage charges for any missing or damaged equipment. Notwithstanding the foregoing, in the event of loss or severe damage, the value of the rented equipment shall be that listed on the manufacturer’s current user price list effective at the time of loss/damage, plus the cost of priority overnight shipping and a 1-day late fee (as stipulated above). In the event of repairable damage, the damage fee shall be equivalent to the estimated repair cost (including necessary shipping costs) plus a late fee (as stipulated above) for the full estimated duration of the repair. However, if the estimated repair fee is greater than the cost of overnight replacement, the Renter will only be charged for the cost of overnight replacement.
  • If Renter wishes to be present (or to have an agent present) during the check-in process (including the inspecting and testing of all equipment, as well as the determination of any losses and/or damages), he/she must specifically schedule an appointment to do so with NGP at least 24 hours before returning the equipment.
  • Renter will not hold Nathan Gardocki Productions or its affiliates liable for any injuries or damages that occur while equipment is in possession of the Renter.
  • It is the Renter’s responsibility to delete any data/footage recorded onto any of NGP’s equipment prior to returning the gear to NGP. NGP will not be held responsible for any loss/leak of data/footage.
  • Renter will submit full payment to NGP for the amount listed on the invoice by the due date listed on the invoice. NGP reserves the right to remove any/all discounts from any order whose invoice is not paid in full by the invoice due date, in which case Renter agrees to pay NGP for the new amount owed. If payment is not submitted by the due date, NGP also reserves the right to charge the credit card(s) on file for the Renter’s account for the new balance plus a 3% processing/late fee. If, for any reason, NGP is unable to process the transaction using the card(s) on file, NGP reserves the right to add the 3% late fee to the rental order and re-submit the invoice to the Renter. For each week that passes beyond the original payment due date, NGP reserves the right to charge an additional compounding 3% late fee until full payment is received.
  • If Renter wishes for this order to be tax exempt, Renter must submit proof of tax exemption at the time of booking.
  • If Renter wishes to cancel this order (or part of this order) after booking, a cancellation fee will be charged. Cancellations made more than 24 hours prior to check-out will be charged a cancellation fee equal to 25% of the total rental cost of all cancelled items. Cancellations made less than 24 hours prior to check-out will be charged a cancellation fee equal to 50% of the total rental cost of all cancelled items. Failure to pick up an order on-time (by the end of the next business day after check-out), without giving NGP any prior notification, will be treated as a cancellation. Once a rental is picked up, Renter will be charged for the full rental, as stipulated in the signed estimate/agreement.
  • If Renter wishes to change any of the conditions of this order, these changes must be submitted and approved before the order is checked out. Any changes made after the order is checked out may be treated as a new order.
  • Upon request, Renter agrees to supply NGP with a Certificate of Insurance, naming “Nathan Gardocki Productions, LLC” as the Certificate Holder. The insurance policy must include “General Liability” (including “Personal Injury”) and some form of “Inland Marine” policy which specifically covers “Rented Equipment” for at least the full replacement cost of all rented equipment. A reasonable deductible must be listed on the certificate. For vehicle rentals, the COI must also include “Hired Auto” coverage, including Auto Liability (with a total coverage limit of at least $1,000,000) and Hired Auto Physical Damage with a coverage limit of at least the replacement value of the rented vehicle(s) (minimum of $100,000). The certificate holder must be listed as “Additional Insured” and “Loss Payee”. The policy must be valid for at least the full duration of the rental (from pickup to drop-off). Renter will not use/store/transport any equipment/vehicles in a way that is not covered by the Renter’s insurance policy. Once an order is booked, failure to provide an acceptable COI will be treated as a cancellation & charged accordingly.
